Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MillionPhones platform, website, API, and Chrome extension (collectively, the "Service") operated by Grow Software LLC ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Account Registration
To use the Service, you must create an account using a valid business email address. Free or disposable email providers are not permitted. Each individual may maintain only one account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
We reserve the right to refuse registration or terminate accounts that use fraudulent or misleading information.
2. Credits and Payments
The Service operates on a credit-based system. Credits are consumed when you access contact data. Credit costs, allocations, and policies are described on our Pricing page and may change at our discretion.
- Credits are non-refundable and non-transferable.
Payments are processed by Stripe. Recurring subscriptions auto-renew at the end of each billing period. You may cancel your subscription at any time through the Stripe Customer Portal; cancellation takes effect at the end of the current billing period.
3. Acceptable Use
You agree to use the Service only for lawful B2B sales and outreach purposes. You may not:
- Resell, redistribute, or sublicense data obtained from MillionPhones.
- Scrape, crawl, or use automated tools to extract data from the website beyond what is available through the API.
- Use data for harassment, spam, or any purpose unrelated to legitimate business communication.
- Exceed API rate limits or attempt to circumvent usage restrictions.
- Use the Service for any purpose that violates applicable laws, including telemarketing regulations (TCPA, DNC lists, etc.).
- Share your account or API key with others, or allow third parties to access the Service through your credentials.
You are solely responsible for ensuring your use of contact data complies with all applicable laws and regulations in your jurisdiction.
4. API Usage
Access to the MillionPhones API is subject to rate limits as described in our API documentation. Your API key is confidential and must not be shared, published, or embedded in client-side code. We reserve the right to revoke API keys that are compromised or used in violation of these Terms.
5. Intellectual Property
The Service, including its design, code, data compilation, and documentation, is owned by MillionPhones and protected by applicable intellectual property laws. You retain ownership of any lists you create and the results of your lookups.
You may not copy, modify, distribute, or create derivative works based on the Service or its underlying technology without our written permission.
6. Data Accuracy
Contact data is provided "as is" without any guarantee of accuracy, completeness, or currentness. Phone numbers and other contact details may change over time. MillionPhones makes reasonable efforts to verify and update data but does not warrant that every record is accurate.
7. Termination
We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service, other users, or third parties. Upon termination for cause, you forfeit any remaining credits.

8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILLIONPHONES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless MillionPhones and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of the State of Wyoming, United States.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If we make material changes, we will notify you via email or a prominent notice on the Service.
